View Full Version : deposit accepted on truck, buyer is nowhere to be found

i took a deposit on my truck a couple weeks ago.... 1500 with the balance to be paid by the 26th or so. I called him a couple days prior and told him id be in texas on that day, and he said he would come by and give half of it now and half of it when i got back (monday) and i said screw it, i wasnt going to do another contract, just plan on coming by monday n ight. I called him last night around 6ish and his phone is disconnected, i havent heard from him at all, and not only are we well out of our written contract, but we are out of our verbal as well as of today.... I did put in the contract that the balance was to be paid by X date and that the deposit was non-refundable, he signed..... thoughts? I mean obviously my thought is to put the damn truck on the market, if he shows up, I'll sell it to him, but i need it gone, so i cant wait for christmas.

I'd give him a couple of days, then put it back on the market.

He knows what needs to be done, he signed the contract, put it up for sale. If he comes along, sell it to him, but if he doesn't, it's his loss. You tried to contact him.

I would have to agree with Sonic. The guy signed the contract, as long as you have a copy of it stating when he would pay the rest of it, and the deposit was non-refundable. I would give him a day to contact you, and if he doesn't, you are buying the keg :cheers:

thats kinda what i was thinking, but here lately my way of thinking has been proven to be wrong in the eyes of others, and rather than sell it at this point, ill just take an even bigger loss as my plans for RV has changed, instead of a Class A, im doing the truck and 5th wheel thing, so id use it as a trade in on the truck.

ummm sounds like you broke the contract not him..... Did I understand that right? You were not available on the contracted day for him to pay you if he wanted or was able to? If it went to court.... You would most likely not win and have to refund him the deposit... All he had to say was he was prepared to pay you on the 26th and you went out of town... tecnically if I understand that right you are in breech of (the original) contract not he......

But maybe I misunderstood...... and Im not a legal advisor in anyway.... Just my .02

Did you get his address, or drivers license number, email address, or anything to attempt to reach him by other means rather than the disconnected phone?

Id put quite a bit of documented effort into trying to reach him just in case.... If you had been available to collect on the contracted day and he never showed.. then he is out per the deposit contract agreement.....

I'd take the deposit and put it in the bank. DON'T SPEND IT!

Trade the truck in on your new ride.

If the guy shows up in the next couple of weeks, just give him the money back. If not, then do what you want with it.

I say give the money to me to hold. I will write up a contract that says I get to keep the money after you place it in my hands. Then in 24 hours I will deposit said money in MY bank account... haha

Check the Sheriff's Office website. Maybe he's in jail. Spent all his bond money on a new truck.

finally showed today... .said he showed yesterday while we were all at work.... even though i said between 6 and 9.... lol..... anyways, i took his money, and the truck is gone....

yeah, even though they rape you on trade in, trade the fucker in..... seriously... nothing is moving right now, ive got several people i know that cant sell what they are trying to sell, i see numerous vehicles on craigslist seemingly decent deals, that park themselves on their ads, renewing every week or so... I was offered 6k for my dakota when i bought the durango, and i should have taken it, but thought i could get at least 8 or 9 for it.

I was going to trade it in, but I can private sell for 9-10k but trade in only for $5,500, thats to big of a cut to take. And I am really not wanting to buy the new truck from a stealer ship because they rape you with a 2x4 with a catus nailed on the top.

i just sold my 03 2500hd for 4000 below bluebook off craigslist. It was the only call I got on it listed that way for 3 weeks. used truck market sucks right now.

Mines a 2000 with 67,070, its the Flex fuel crap so I can hype that up for the sale as well. Thats why I don't want to go to a dealer.

sorry, what I ment was between KBB and NADA the price is from 8,800 to 10,400 for private sales. I wish I had a cash offer.
