the way the law will be written, and the way it will be enforced can be 2 totally different things. And why is it that ANY company that produces legal products cannot give out free samples? Because those who do not smoke, and are nicotine Nazi's, wish to force their views on the rest of the world. They are not happy just being a non smoker. They HAVE to force everyone to live the way they live. I don't drive a chevy. I think they should be outlawed. Because I know what is right for you and your family. And you obviously cannot make good decisions on your own.

Here is one from personal experience:
I use to be the Operations Manager at Fiddler's Green Amphitheater in the DTC (this was back in the early 90's). Well, we had a contract to hand out those free 1/4 packs (five smokes in a box) to the public as they were coming in to a concert. So there I am standing in front of this 60 foot long transport container, crammed full of cigarettes--like the kind you see being transported on ships-- handing my staff baskets full of smokes and saying, "Alright, if they look old enough to smoke shove 'em in their hand!" and at the same time I'm yelling out to 100 or so employees, "And if you see a ticket scalper, toss 'em in the weeds!"
Anybody here use to work for me or in the concert biz --Fiddler's, Mammoth, most any other show house in town? Man those were the days... partying with the real "Rock Stars".

So we just made it tough for them to do it on property where we were responsible for the general movement of traffic. Sometimes it would be a contest to see who could yell louder, from the same corner, a group of scalpers or my staff directing people and cars.
Yah, for four years, it was a fun job and I saw my fair share of "back stage" reality.

They (cigarette companies) are not allowed to hand out free sample. You are still able to bum cigarettes from friends. Since second hand smoke contains class A carcinogens and since nicotine is an addictive drug that the ATF decided to regulate, it is not really out of line that they limit giving away products. They are probably going for a two prong rationale - it is difficult to make sure no one under 18 is getting the free product (violating the law that no one under 18 can use tobacco) and it encourages smoking in public places (which is a weak argument). The tobacco industry only exists because it had a better lobby than the marijuana industry.
Now, let those who prescribe to the moral outrage theory of political discourse and those who subscribe to the political correctness theory weigh in.
Oh, and smoke 'em if you got 'em. Just not in my bar.

Until it is illegal for adults to possess, use, and distribute this "Controlled" substance, I should be free to possess, use, and distribute. Caffeine is is addictive too. I get free samples at FiveBucks all the time. Aspirin is an FDA regulated goodie but I get free samples in the mail. The hate on smokers is that it has a byproduct that non smokers do not want, smoke. If you do not like going into a bar that is filled with smoke, go to another bar. Don't take away my right to enjoy a smoke, in public, with my friends, without freezing my ass off on the patio.
Unfortunately issues like this do not mean as much to most people or have an effect on them, as it does to me. I am being bullied out of a freedom. One day the bully needs to get punched in the nose.
