Got my motogp kanga suit in the mail yesterday which is also the day i got my bike back. so i went riding today to see how it felt on the bike. i was heading to some mountain roads and going to some small town when i get a call from a coworker to meet up and buy pizza for some party tonight. so i get lost trying to find place but wait. im in a familar area. i need to make a u-turn and head down the road im on. so i turn around and hit the gas. first to second. not really ripping on but i was moving a bit. i realized i was speeding so i let off the gas hit the rear break and take my hands off the bars to get some air in my suit. i stop at a light with cars all around me when i hear a cop horn. i see him. pull over and he stops me. writes me up for careless driving(wtf is that) and tows my bike. this cop was a dick aslo.. anways, good news is i can get my bike back whenever i go down to the yard. courtday follows and i need to find a lawyer. thanks for reading and goodnight.

You want to spend the cash on a lawyer for a "careless"? If it were a wreckless, I could see that, but they're probably gonna plea you down on your careless. :dunno:
Anyway, if you really do want a good lawyer, I can give you the name of mine. She's quite stellar, and even though she is not in Loveland, I'm sure she can rep. you, or at the very least, get you in touch with a collegue (sp?) of hers, up in your neck. You’re not giving us the details to the conversation with the officer.
You have a CSC member-to-member privilege here. Similar to an attorney-client privilege, except the legal oath appearance before the honorable judge; blah, blah, blah. :D
I’ll go out on a limb to say you’re not experienced on dealing with tickets. It’s great that you want to fight the revenue ticket, but really, just go in for a plea bargain offer or fight the ticket. If you can’t sleep at night, call up the DA’s office to find out what the typical process is, standard fees and prearranged plea bargains/limitations the local jurisdiction adopted. The points against your license, affects you more than the fine amount, in the long run. Ask for a 3 month deferred sentencing and follow the requirements.
You owe me $150…it’s $50 off/hour day ;)
BTW: Given that your bike was towed away; there would be a moment where you could have slept with the officer’s daughter before the tow truck arrived. :P (Hints you shouldn’t say any more than necessary to the officer during a intervention stop)

yea im not to used to tickets. (2 speeding tickets in about 4 years) but i dont really know what careless is so i was going to talk with a lawyer to see my options. the cop said it was a 4 point ticket.

It's a 4 point ticket, usually dropped to 2 without too much hassle by a DA. Typically, unless you really piss them off (or get caught without all your wheels on the group) careless is their hold-all ticket when you are caught for a couple more minor (and potentially less proveable offenses). In your case, the fact that you u-turned at what sounds to be something other than a marked u-turn acceptable area, then quickly accelerated to a speed above the posted speed limit is going to be an easily won careless ticket on the part of the cop/DA. Take the plea, pay your fine, move on with life and count your blessings lucky that you didn't get a wreckless or exhibition of speed.
Note: the above posted statement is in no way an admission of any alleged first hand knowledge of such things as I am a perfect angel. :angel:

I must agree with everybody, try to talk to the DA, if you cant get a deal you want, they will schedule a date and time for you to see the judge, THEN you get a laywer :up: . I just got a 9point ticket earlier this year, contacted Barn's lawyer who assured me I could do it myself, and I did, got it down to a 2point - from a speeding 20+ plus out of state Driver license and no registration here in CO, they dismissed most of it and it went to a defective vehicle, paid $60 and its gladly now over :)

i caught myself a reckless in cali a few months ago.. i just bit the bullet and paid the price..... but speaking of that.... why did they tow your bike??? was it trooper or local.... i was very nice to the cop even in cuffs and he let me go with my bike and didnt write down what i was really doing... did you just get a cop that was having a bad day???? or was there a little more testosterone then could be allowed on the side of the road??

i got a ticket for doing 80 in a 65 whilst in the HOV lane without a Tilly, and then the cop got pissed cause i wouldn't pull over on the shoulder of the highway, instead i went to the next exit and pulled into a parking lot. these cops, i tell ya! I dont understand what they get so worked up over, i mean, i was looking out for his ass..
"i've seen those clips of cops getting broadsided by drunk motorists, and i was only in that HOV lane by myself to pass the truck, i mean i thought it was the law that the far left lane was for PASSING, maybe seperating the HOV lane on HWY 36 is an idea..... just maybe....."
yeah, so the cop didn't buy that and gave me a big ass fine and a couple points off my license. That turned out to be the most expensive hair appointment ever! and i was still late. fauck!
the point of my post? none really, just plea it down and pay it. :D

This will expose my complete ignorance but without the info, I am left clueless. What is a Tilly?
I agree that he should not have got pissed. You read about how women should pull into a lighted area with people around incase the cop is an imposter and to move out of traffic for safety. You should report it to his commander and relay the feeling you have for the complete disrespect for your safety. (Although his commander may laugh at you if you were speeding on your bike and this "Tilly" thing was somehow breaking the law as well)

Careless isn't bad, and with a relatively clean record they will plea it down a couple points anyway. Just go in to court, wear a suit and look nice, and admit you f'd up. The DA will likely have your plea agreement written up before you even come in anyway. If you don't like it, you can decide to fight it at that point and plead not guilty, but it isn't worth the cost of an attorney at this stage.
Towing your bike does seem extreme to me though. What reason did the officer cite for doing that, or what did you say to him to incite that response? I've been caught doing much worse on a bike and kept my ride just by showing a little respect (like when I should have gone to jail instead of riding home with a 12pt ticket and my hands not cuffed).

Here is what Careless Driving reads in Longmont, this is probably pretty standard across the state:
"1402. Careless driving. Any person who drives any motor vehicle, bicycle, or
motorized bicycle anywhere in this city in a careless and imprudent manner without due
regard for the width, grade, curves, corners, traffic, and use of the streets and highways
and all other attendant circumstances, is guilty of careless driving. A person convicted of
careless driving of a bicycle or motorized bicycle shall not be subject to the provisions of
section 42-2-127, C.R.S."
In other words, it's vague, which means even with an attorney you might not get it thrown out. Is it really worth the trouble? Doubt it. They got ya, go get your plea deal and pay the fine, don't do it again. Or go spend hundreds of $$ to do the same thing with a lawyer. :dunno:

Call the court house and ask to speak to the DA, give em your ticket/citation number and ask what kinda plea you can get or if there is an automatic one on the ticket by mailing the ticket and fine in. most tickets are like that, they automatically drop it down if you just mail in the fine.
it's been over a year since i had that last speeding ticket, but that's what i did and it was dropped to faulty something or another and it went from 4pts to 2 or 3, can't quite remember.

I can't see them offering a disposition by mail, in the case of a careless. I'd think they'd at least make you attend your arraignment. :dunno:

When you get to the court, just check in with whoever you need to. You will be advised of your of your rights, either by the magistrate/judge, or they will just give you a sheet of paper to advise yourself.
After that, you will be given an opportunity to talk to a prosecutor, who is representing the city/county.
This prosecutor will be the person who is going to review your charges and all of the officers "discovery". After doing that, they will tell you what (if anything) they can plea you down to. This disposition is what people often refer to as the "plea bargain".
Basically they will tell you that you can plead guilty to XYZ Lesser charge, and they will dismiss the original charge. In your case, careless driving.
An example would be having you plead guilty to a 2 point "failing to stay in a single lane" violation, or something like that. Of course with this guilty plea there will be the various fines and court costs.
In a nut shell, you will be pleading guilty to a charge that is not a serious as what you are actually charged with, and thus have fewer points against your license. Additionally, you will pay some cash, and everything will be over and done with. It's done to save the court valuable time, while still punishing you to some degree.

I got a careless ticket when I wrecked in the canyon. I would not even bother with a lawyer. It is a 4 point ticket and a fine. If you pay it early (don't even have to go to court) just mail it in, they will give you 2 points and I think a $58 dollar fine. It still will show up as a careless on your record (I personally didn't think it was a big deal) but only 2 points. So IMO I would just sign the ticket and send it in with your check and be done with it.

In a nutshell, Careless Driving is a criminal offense, not civil. So, you likely need to go to court to handle it. This isn't much different than mailing it in, except you spend a morning of your time and some more money doing it.
When you arrive for your court date, the DA will speak with you first. They will go over any available plea agreement, and discuss your intentions. If you choose to accept the plea tell them so, and you will go into the court room at that point. When the judge calls you up he will re-read what you and the DA discussed for the court records, and ask for your plea of guilty or not guilty. If you accept the plea, say "guilty", pay whatever fine he tells you to, and you're on your way. If you decide to get a lawyer and fight it, say "not guilty" but understand that they do have a case against you.
In the plea they'll choose a lesser offense to get the points down, like faulty vehicle or something.

I heard of a bike rider dismissing a Reckless Driving ticket by his choice words with the Judge regarding his abilities and skills beyond the current racing license that he had.
The case number is the way of tracking your summons.
Careless Driving is a summons to appear, which you can delay if need be. It’s call “Continue by Defendant” or “Continuance by Defendant”.
You will go into the courthouse for the “Arraignment” or “Plea And Setting Hearing”. You may speak directly with the police officer that gave you the summons or what Barn said in a previous post.
I have laughed at a Clerk of Courts before on the plea offer and set a court date for the Judge. The officer showed up for the court appearance and dismissed the ticket two months later, never saw the Judge for that one.
Don’t admit guilt or no contest until the end. Don’t deny anything by keeping your mouth shut.
Give 100% attention to the DA, by listening.
I have countered the offer of a district attorney in Adams County and he took it. My counter was zero points from a 6-point ticket by the freaking way.
Study up on the basics of your ticket. Have confidence while speaking. Don’t be a wussy.
A calm attitude will get you further. :yes:

I wonder if it is different in each county. A lot of you guys are saying you have to go to court. When I got mine (larimer County) it was written right on the ticket that if you sign the ticket excpeting the charge they reduce it by half (so the 4 was dropped to 2 automatically) and you just send a check for the fine (cheaper because you don't have to pay any court costs) with you ticket you don't have to even show up to court. That's how mine worked out, so I am wondering if it is different for each county. But he said he got one in Loveland so that is Larimer County so he should have that option.

I'm certain that it depends on the jurisdiction, I just would have never suspected a "pay-by-mail" on a Careless. I always figured those were reserved for minimal speeding tickets.
My guess is if that were an option though, that the officer would have told him, or he would have read it on the ticket itself, and this whole conversation wouldn't have been needed.
Since dude got his bike towed though, it never even entered my mind as an option. To get towed on a pay-by-mail ticket just sounds funny. :lol:
