Darn that pesky Bill of Rights thing....


Many progressives like to say that the Constitution is "a living document, subject to interpretation in a modern context". I'm with Justice Scalia, in that the Constitution is to be interpreted by the courts in the context of the language of the authors. Attempts to abridge our rights by rationalization should be strongly repelled. The Constitution DOES have the ability to adapt and grow, it's called the Amendment process, and it was deliberately made arduous by the framers of the document to prevent frivolous (Gay marriage, cyberstalking, etc.), transient issues from being written into the highest laws of our country.

Yeah but why go through the nutroll of getting an amendment when you have judges who will just interpret a new power or creatively expand an enumerated one (*cough* commerce clause)? You're so right Jim, it was purposefully made tough to amend it.
