god damnit. i dont see this one going well at all. i wouldnt have pulled the trigger but thats me. i can see why the old man did. hope he beats it.

Wow, was that NewHampshire or SanFrancisco?! Totally absurd. Hopefully he has a clean record and the court completely dismisses the case, even if he can't afford a lawyer. Having so many guns, I'm guessing he's an NRA member and they also come to his aid.

I realize the law is in place for idiots who indeed act reckelessly with their guns, but this is not one of those cases obviously!

I have very little use for anything east of the Mississippi and north of the Mason Dixon line. We get used to the relative amount of freedom and common sense here, so much so that it comes as a shock what repression exists in the coastal states. Ron Paul got it right, we are devolving into a fascist police state, much faster than anyone realizes.

Reminds me of my grandpa. When he was living in Castle Rock, a couple of neighborhood kids broke into his garage. He chased them away once, but they came back. So he flashed a gun and chased them off again. 20 minutes later police showed up... Grandpa informed them that if the kids came back, he'd shoot them. To which, the police replied with 'If you do, then we'll arrest you and throw you in jail'. His response, 'That's fine, I'm old, ugly and a widow... I could use some company"

Bob Wallace screwed himself when he spoke to the police without an attorney present. He made some statements that damaged his defense, in addition to lying to the police. In Colorado you can't use lethal force in defense of property, only when you are in fear of death or great bodily injury. He should never have fired at the REAR of the thieves' truck.

He should of said it was an accidental discharge...I did not read the whole story but I'm guessing he admitted to purposely firing a warning shot...LOL Never do that. Just say you were nervous and felt threaten and the gun went off (must of pulled the trigger while shitting pants). Also don't talk to the cops, call a lawyer...let the lawyer decide which way to go.

Agreed with Wulf. The FIRST and ONLY thing you do in this situation (after calling 911, if someone else hasn't) is get a lawyer and DO NOT talk to the cops without that lawyer present and representing you. It's incredibly easy to incriminate yourself without even realizing it, and if you just killed someone that's a bad time to mess up.

Well, unless that's actually true then you've lied to the cops, and they are much better at uncovering the truth about these things than you are about hiding it. Do not lie to the cops. Just don't talk to them without a lawyer. You may be 100% in the right and know it, even still make sure you are represented before giving a statement.

And lying to the cops is bad, so unless you're speaking the truth, STFU. The right to not incriminate yourself usually implies not speaking, even when you know damn well you were in the right.

Yeah the cops are supposed to do the same thing. Grim recently proved this in traffic court. Cops do not always have your best interest in mind. Many times the only evidence they have is that you have given to them. Maybe you don't agree with all of it, but admitting nothing is sound advice.
