Question how to handle this mystery ticket?

Soo... here is the story i was on base on my bike. I was making a right turn from Khe Sanh on to Specker heading north. There was a MP chilling about 300 meter north on the west side of the road facing east. So i stop and put my left foot down, then take the corner. After i pass her she pulls me over and gives me a road side interrogation. she asked me do i know how fast i was going, have i been drinking ( mind you its like 5 in the afternoon), where i am going in such a hurry and even had her holster unclipped. But i play it cool answer respectfully. Then she comes back and tells me im getting a citation for failing to make a 2 legged stop and writes me a 4pt. ticket for failing to stop at a posted stop sign.

I want to take this to court so i don't pay and wait for the court date to come in the mail and wait and wait and wait some more...When i go to get a decal for my car the guy specialist says "ohh so you got a ticket, huh?" So now i'm worried thinking something is up. I call the central violations bureau and ask if i missed my court date, because i never received the notice. well... They tell me they never received a ticket from the MP. I then wait some more now its over 14 months have passed since i got the ticket and still no court date. The just checked with the CVB, CVB lady told me to don't worry about it.

What do you all think i should do?

write down all the times, dates and personel you spoke with at the office that said you didn't have a ticket and "not to worry about it" and keep it somewhere safe. Most likely someone saw the ticket and tore it up because of the stupidity of it. But to be safe I would write all the info down and throw it into your safe.

I would get to the bottom of it. You can't trust anyone in the circle of ticket fines. Even if you cite all the people involved, they'll just say that they weren't authorized to dismiss your ticket and then you'll end up with a suspended license or something. Do your homework or you'll pay for sure eventually.

I think this is how you should fight the ticket... make sure to bat your eyelashes more at the judge and you should be able to get off... good luck....

was this on base or post? if it was then there shouldn't be anything other then points. after so many points you can't drive on base/post. i think its like 6 or 8 points then you can't drive on base/post.

Points on base are 12 in 1 year or 18 on two. No such thing as a required two legged stop. She was lookin for a date!

Unless things have changed since I was in the Army, tickets received on military instillations are NOT pointed offenses. By that I mean they do not report back to the state you have your DL issued through. It's possible they have their own point system that can suspend you privilege to drive on post, but not your actual DL. Either way, I wouldn't stop until I got to the bottom of the situation and I'd keep my chain of command apprised of the situation in case this comes back to bite you.

Also, like Wendell said, there is no such thing as a required two-legged stop. Once the wheels have stopped turning, the vehicle is at a stop. You can stop the bike without putting your foot down if you have good balance.

^^ Ya, technically you don't have to even perform a one-legged stop if you've got incredible balance. You just have to completely stop the wheels from rotating and moving forward. Also, I'd have asked her about a two legged stop and if she said that you had only performed a one-legged stop, then ask her why you were receiving a ticket for running a stop sign.

I don't know about the Army, but in the AF, ticketts are handled by the 1st Shirt. Even for civilians and contractors. I would take the advice above, write everything down and find the 1st shirt and tell them the whole deal.

That way, if it does come back to you, you have proof you informed your chain of command, and you're covered.

Next time, tell her you'll do a "3-legged" stop from now on.

    Get you that date...

I recommend going down to the Provost Marshalls Office (PMO) and see if they have a record of it or if it was added to the daily blotter or staff duty journal.
If they say there is no record of it, you are good to go. Typically if you fail to handle military tickets, your chain of command is notified; so i'm guessing it was never turned in to the Traffic/Desk SGT.

A side note, two kinds of tickets on base, a DD form 1408, only has on base points, and a DD form 1805, this is a magistrate ticket, carries on and off base points and a fine too.
Like Mental said, go to your 1st Sgt, and the Provist Martial office for more info. If it was a 1408 the patrolman may not have submitted it, if not, then it was not processed.

I believe tickets on post, stay on post and have nothing to do with the state. I think all they do is notify your chain of command. But I may be wrong.
