Daytona 200 last lap crash penalties

You all saw the last lap crash of the Daytona 200 (or D150) no doubt (http://www.youtube.com/watch?v=4nvZ_uFCY7M).

DMG has reached a conclusion and issued penalties: http://www.superbikeplanet.com/2011/Mar/110321d.htm

Wow. Eslick can pull shit at the end of last year and get nothing, while Herrin makes a pass and bumps someone's brake (to me it looked accidental, the brake, not the coming back down) and get suspended?

I agree with Wicky for the most part. I think Herrin was weaving back and forth excessively coming into the tri-oval but I don't think his intentions were anywhere near as negative as Eslick's riding last year that went unpunished.

I don't get how Eslick gets away with his actions last year but Herrin gets penalized this much. I'm guessing because of the speeds, the potential for a fatality was high? I guess I could understand that...
True, Herrin was weaving excessively a bit at the end, but if you watch earlier, it seems Westby was also weaving into him a couple of times prior to Herrin coming down.
If Checa can torpedo Neurkirchner and give him a broken arm without penalty, I would think Herrin should not have either. I just think it was a racing incident... Not sure what this solves...
