It is a cycle of mental anguish . Some prisoners are there cause of their molestation . it screwed them up in life and swayed them to a behavior that sent them to prison. So when they find out of child molester coming into the joint it's a field day.

I have a friend that this happened to, he didn't catch him in the act, but his 5 y.o. daughter told him that his BEST friend had touched her naughty parts. The guy didn't do anything other than kick him outta his house. Now he's only serving 4 years in prison...not long enough in my opinion. I would have to say if someone...anyone did this to my children...I would have done the same thing as the guy in TX. The destruction molestation causes to a person NEVER goes away.

I'm not sure this would fall into temporary insanity, but even if it did he'd still be charged and imprisoned, just at a mental hospital instead of a prison.
The defense they'll take, if he is charged, would be heat of passion. This basically states he did not have the mindset required to commit homicide. And in my opinion based upon what I've read, even without heat of passion he lacked the mens rea required for murder. Thus the highest he could be charged is manslaughter. Well defending another person from bodily injury is an affirmative defense to manslaughter, and I can't imagine a judge or jury finding that a sexual assault is not bodily injury. I doubt a sexual assault rises to serious bodily injury, though I'm sure the concept of mental injury has been compared to serious bodily injury before, I'll look up case law.
However, I highly doubt he'll be charged in the first place, especially with it being Texas.
