    Selling a gun in CO

    Anybody know how this is done? Do I have to do any sort of paper work to transfer ownership? I've got a 22 assault rifle that I never shoot and could use a couple bucks to fix up my RR.

    Doesn't it have to be done through an officially licensed (FFL) dealer? Just call GanderMountain, SportsmansWarehouse, BassPro, or another gun shop. They can tell you exactly.

    No.

    Private sales can be done in Colorado no paperwork whatsoever. Some people CYA with a Bill of Sale, but that is all their prerogative.

    The only real stipulation is that you don't sell to someone if you know they are not legally allowed to own said weapon.

    ie, don't go selling to someone who you know is a felon.

    I'd strongly suggest incorporating a Bill of Sale in the transaction. If the gun is ever used in a crime or sold to a minor who injures him or herself, as the last registered owner - you're the first person getting a phone call from the cops.

    Although a BOS may scare off prospective buyers, in the end it's your ass on the line - not theirs. This isn't about liberty or the 2nd amendment, this is about you being prepared in the event the buyer isn't the stand up member of society he claimed he was.

    It was always my understanding that when purchasing a firearm through a licensed dealer, at least in Colorado, the name, address, etc. filled out on the background check form (via the Brady Act) is stored on file with the feds. Doesn't the form also include the gun type/serial number that is wanting to be purchased?

    It looks like even the RMGO site claims the Brady Act falls outside CO's "registration" rules.

    (the federal Brady Act is another matter, though that's not "claimed" to be registration)
    This is why I was always told to get a BOS when reselling any firearm ever purchased through a FFL dealer. Because if you filled out a background check form - your name, along with that gun's serial number, are on file with the government.

    According to ATF Form 4473 the gun type is required in two locations, and the serial number in one.

    See Item #18 on Page 2, and Items #26, #27, #28, #29 and #30 on Page 3....

    Are Colorado citizens required to register their firearms? NO. In fact, state law prohibits firearms registration by local or state government (the federal Brady Act is another matter, though that's not "claimed" to be registration).

    The reason I mentioned a licensed dealer in the first place, was because I thought it was required to be done through an FFL when you buy online through a facilitator like GunsAmerica or similar outlets? Dunno how that works with CraigsList, etc.

    Not usually, but sorry, in this case, yes I'd like it to be a little more organized than a free-for-all. I don't think any random person should have the right to sell a firearm to just ANY other random unknown (rare but possible psycho/felon) person at will. Just my opinion. This isn't the Little House on the Prairie era. I don't believe in adding new laws, just enforcing the existing ones and keeping guns out of the hands of known criminals. Unfortunately the douchers have to mess it up for regular hunters, collectors, sportsman, etc. I'm sure most people will disagree, but so be it.

    Btw, I'm an NRA member, and not anti-gun rights.

    ^ I agree. I just want to make sure my a$$ isn't gonna go to jail cause the guy I sold a gun to decided to shoot somebody. Bill of Purchase for sure!

    It is a nice looking case. I would be interested in finding out if you get a minute

    In the intention on jacking the shit out of this thread (now that the sale thread has been posted), I am looking for a new case. Now that I have a scope on my AR it wont fit in the OEM Sig case.

    I want a bad ass case, would look at both hard and soft cases if anyone has some direction.

    Also agree with what Townie said, but still don't like a free-for-all anything goes. And I would definitely CYA for sure, good plan. Unless you're selling to family member or friend, that's different. Even most people on forums could be complete unknown strangers.
