Guy gets hit by driver

On March 26, 2015, I was driving to work on my motorcycle. It was a fairly typical commute, full of cagers cutting me off, merging into me and generally just not paying close enough attention. As I was filtering up to the front of a light, I noticed one particular man in a black BMW convertible. He was very busy texting and talking away on his mobile phone. He became visibly angry when I yelled at him to put down his cell phone while he was in his car. Even after he honked at me, much to my surprise, I kept my cool... I didn't flip him off or get into his face, however much I wanted to. Once the light turned green, I proceeded through the intersection, making my turn. Behind me, the BMW driver came flying up behind me very aggressively. After a couple of blocks, he pulled into the center lane to my left and, once he was parallel with me, swerved his car into my lane, knocking both my bike and myself to the ground. Without slowing, the driver took off down the road.

Aside from a significant amount of bumps and bruises, I suffered a severe concussion (bad enough for me to forget what day, month and year it was and knocking all memory of the past week out of my head), two hairline fractures in my left shoulder and a broken left foot (which would require surgery).

Because the driver is currently under criminal investigation, I will be unable to go after him or his insurance. for any sort of compensation for quite a while. Additionally, the insurance on the car (which was not owned by the driver) only has a very small amount of coverage for medical and property damage. All of this money has been swallowed up in one quick swoop by my significant amount of bills. I'm left still having to pay several thousand dollars for my health insurance's out of pocket maximum. Additionally, I'm left with several bills associated with purchasing medical equipment (crutches, shower seat, etc.) and transportation (car rental, Lyft rides). My credit cards are close to full-up and these bills will be coming due very soon.

That's when you figure out the driver's license plate number, track him down, and serve him court papers yourself. At the barrel of a loaded firearm...

I agree, maybe he shouldn't have yelled at the guy for texting while at a red light, we didn't see nor did the rider......see the driver texting while driving. But, for the BMW driver to intentionally cross the double yellow and then swerve and hit the motorcyclist, that is just plain attempted murder, hopefully there will be a good mix of justice and karma serving him.

The bike rider probably should have carrier better insurance himself as well. The State minimum in California is 15/30 for Bodily Injury coverage and that would easily be exhausted by the med bills if that is the only coverage the at fault driver had on that BMW, which is odd for someone driving a BMW, but hell its California. The rider's Underinsured Motorist coverage would extend beyond that if he had it as well as medical payments coverage. But insurance in CA is so expensive most bikers get the bare minimum they can.

I refuse to carry low limits on my cars or my bikes and that will be a lesson to the biker himself to keep adequate coverage.

But for the BMW driver I do hope that he gets a steep charge for this as I agree this appears to be an attempted murder by him. This means nothing against anyone on the forum but I do feel at leats when I was in CA that most BMW drivers drive around like they are entitled assholes. Fuck them!

+1, While the rider probably should not have done what he did there was no call whatsoever for what the driver did and I hope he gets the attempted murder charges.

This was my exact argument on Google+ discussing this story. Not that the driver is excused for hitting the biker, but why did the biker have to be a douche? Someone said using a cellphone while driving is against the law in all of California. Agreed the rider was a douche, but there is no excuse, even douchiness, for the BMW driver's actions. He needs to be shot with small caliber rounds in non-vital areas before being left in the desert 100 miles from any water.
