But if that manhole was open and unattended and not barricaded off, the parents may have something to go on. OSHA is pretty clear about open manholes having protection preventing just this kind of thing.

Yes they should've coned off the manhole, but seeing as her head was buried in her phone she probably would've walked into it anyway.
She didn't get hurt other than a few cuts and bruises so screw the lawsuit, sounds like a learning experience for both sides.

I read that in London, they're considering padding the poles and painting a center line down the sidewalk for the folk who text and walk.
It'd be interesting to vandalise the street by painting the line to the left and walking texters into traffic, a-la Road Runner
